​Model Workplace Violence and Bullying Prevention Program

The Model Workplace Violence and Bullying Prevention Program, as referenced in Article 10.21 of the State’s MOUs with SEIU, is intended to provide guidance to all state departments in developing their own Workplace Violence Prevention Program.  As stated in the ​Model Workplace Violence and Bullying Prevention Program, state departments may continue to use their existing program if it contains all of the following elements: Workplace Violence Policy, Purpose, Legal Authority, Definitions, Responsibility, Compliance/Discipline, Communication, Incident Reporting, Hazard Assessment, Incident Investigation, Hazard Correction, Training and Instruction, Reporting and Record keeping.
 
In light of the addition of recent provisions regarding bullying in some of the MOUs, state departments may choose to leave their policies in their current form if they believe they already address this issue, develop a definition of "bullying" that works for their specific department, or otherwise revise their program or policy to reflect that it extends to bullying in the workplace.  Departments intending to modify an existing program or policy or intending to develop a new one must work with their assigned CalHR Labor Relations Officer to determine if there are any bargaining obligations.
