Military Leave - Retirement Benefits

While you're on military leave, you may retain your membership in the California Public Employees' Retirement System (CalPERS). You can also withdraw your accumulated contributions after your State salary ends.

If you return to State service after your military leave within the time limits for reinstatement, you'll receive credit toward retirement for the time you were on military leave.

While you're on military duty for war or national emergency and receiving the difference between your military pay and State pay, retirement contributions don't come out of your State pay. You'll receive CalPERS service credit for military duty under per GC Sections 20990 and 20998. The State's responsible for paying both the employer and employee contributions per GC Section 20997.

If you want more information about your retirement rights and how they're affected by military leave, please contact the Membership Division at CalPERS.
