Re: Addendum to Bargaining Unit 18, Department of State Hospitals (DSH) and the California Association of Psychiatric Technicians (CAPT) BU 18-Stockton Activation

This is to inform you of a recent agreement reached between the State and CAPT regarding the activation of the new DSH Stockton facility located within the California Health Care Facility. The attached addendum will expire no later than January 1, 2015, and addresses the hiring of staff for the new facility. There is no fiscal impact related to this agreement.

Addendum

AGREEMENT BETWEEN THE STATE OF CALIFORNIA, DEPARTMENT OF STATE HOSPITALS AND CALIFORNIA ASSOCIATION OF PSYCHIATRIC TECHNICIANS BARGAINING UNIT 18 REGARDING DSH-STOCKTON ACTIVATION

The California Association of Psychiatric Technicians (CAPT) met with the Department of State Hospitals (DSH) on May 20, 2013 regarding the activation of the new DSH-Stockton (DSH-STK) located within the California Health Care Facility (CHCF). DSH intends to follow the provisions of the Bargaining Unit 18 Collective Bargaining Agreement (CBA) except for the items detailed below. Specifically for DSH -STK activation the following was agreed to:

 

1. Duty Statements

 

DSH-STK has provided the current draft duty statements for BU 18 classifications. CAPT is in agreement with these drafts. If the duty statements are significantly changed prior to the arrival of the first patients, CAPT will be provided revised copies.

 

2. Work Schedules

 

DSH-STK will utilize the 6/2 forward sliding work schedule upon 24/7 activation of a building. Between 9/15/13 and 10/1/13, upon CAPT's request, the DSH shall meet with CAPT to discuss and consider a different work schedule for level of care employees.

 

3. Post and Bid

 

Post and bid will be suspended until 3/3/14. Until 3/3/14, as buildings are activated DSH-STK will post 50% (equal distribution on all 3 shifts) of the available Psychiatric Technicians (PTs) shifts. All PTs will be allowed to select their shift (AM, PM, NOC) and building by seniority. The State will provide a form to use for this process which will indicate this is a temporary assignment and expires on 3/3/14. On 3/3/14, management agrees to follow the Post & Bid language in Article 9.2.

 

4. Physical Abilities Test Waiver

 

DSH-STK management has obtained authorization for a temporary waiver of the Physical Abilities Test (PAT) through 4/15/14.

 

5. Leave Requests

 

Until 12/31/13, DSH-STK will post the time off calendar by the 10th of each month for the following month. On a form provided by DSH-STK employees may a time off request for up to six (6) consecutive days off. This form shall be submitted by the 20th of the prior month. Time off shall be granted in order of seniority.

 

6. Seniority Scores

 

Seniority is determined by total state service. Ties will be broken by hire date then the last 4 digits of the social security number. The lowest last 4 digits of the social security number is the most senior. Seniority list shall be available electronically. After 1/1/15, DSH-STK will follow the BU 18 contract re: Seniority Scores.

 

CalHR must send a copy of the agreement and any cost estimate, if applicable, to the Joint Legislative Budget Committee (JLBC), subject to their review and approval. These agreements are posted to the CalHR website. This agreement expires no later than January 1, 2015.
