The proposed modification is to CalHR rulemaking file, #2023-0609-04S, regarding the Savings Plus Program (SPP) Contract Bidding Process. It was originally noticed to the OAL on December 2, 2022. The proposed amendment allows SPP to comply with the state’s competitive bidding process and for the program to be nimbler when needed. In cases where there is a high risk of a contractor losing assets or being unable to fulfill the duties outlined in the original agreement, SPP should be allowed to employ a modified competitive search process for selecting a replacement contractor to manage program assets or effectively handle the original agreement’s duties. This flexibility allows the SPP to meet its fiduciary obligations and safeguard program assets. Amendments are technical in nature; however, all are available for public inspection and comment. CalHR will accept written comments based on these proposed changes from November 1, 2023 to November 17, 2023.
