Overview

Presented by CalHR Legal Division House Counsel: A practical overview and update that will provide tips and resources to help you comply with the law, while still managing your workforce. Participants will review the key leave laws including the federal Family Medical Leave Act (FMLA), the California Family Rights Act (CFRA), and Pregnancy Disability Leave. During these training sessions we will discuss ways to curb FMLA/CFRA abuse and provide participants tools to help manage employees using FMLA/CFRA leave on an intermittent basis. Additionally, this class will also provide participants with an opportunity to practice their skills and knowledge in handling complex situations involving FMLA and CFRA through in-depth group discussions. Participants will explore complex fact patterns involving management concerns, compliance issues, and the overlap between FMLA/CFRA and other laws and regulations governing medical leave, including the American with Disability Act (ADA) and the California Fair Employment and Housing Act (FEHA) by discussing and working through complicated hypothetical factual scenarios.

Objectives

This training will provide information and guidance in understanding the federal and California leave laws. Learn how to identify a serious health condition, how the military leave laws have changed, and understand the changes in the Pregnancy Disability Leave laws. Understand what intermittent leave is and how to best manage it. Gain practical tips on complying with and administering the FMLA/CFRA.

Upon completion of this course, participants will be able to:

  • Recognize some of the complex compliance issues related to FMLA/CFRA usage.
  • Understand Pregnancy Disability Leave and the interplay between FMLA and CFRA
  • Effectively manage FMLA/CFRA leave without interfering with the employee’s rights
  • Use practical tips to navigate complex factual scenarios involving FMLA/CRFA and the ADA/FEHA

Intended Audience

This class is open to State employees in the Executive Branch. Supervisors, Managers, and Human Resources Staff.
