Medical Information in the Hiring Process

Overview

Presented by CalHR Legal Division House Counsel: This full-day course is designed to provide participants with an understanding of the types of information employers can require from applicants and employees. The course will focus on what medical information can be requested from applicants during the application and interview process, from an applicant after an offer is accepted, and from an employee after appointment. The course will also discuss the reasonable accommodation process for employees and applicants.

Objective

Upon completion of this course, participants will be able to:

  • Conduct interviews and examinations for appointments in compliance with the Fair Employment and Housing Act and the Americans with Disabilities Act;
  • Engage in the interactive process with applicants during the applicant and interview process;
  • Conduct pre-employment medical screenings in compliance with the law; and
  • Understand the fitness for duty process for employees.

Intended Audience

State employees in the Executive Branch, Supervisors, Managers, Reasonable Accommodation Coordinators, EEO Officers, Attorneys, and Human Resources Staff.
