JLBC Response Letter

Dear Ms. Chapman:
 
On May 7, 2013, the Joint Legislative Budget Committee (JLBC) received: (1) two packets
of addenda to the memorandum of understanding (MOU) for Bargaining Units 6 (represented by
the California Correctional Peace Officers' Association), (2) an addendum to the MOU for
Bargaining Unit 7 (represented by the California Statewide Law Enforcement Association), and
(3) an addendum to the MOU for Bargaining Unit 8 (represented by the California Department
of Forestry and Fire Protection Firefighters). These bargaining units represent state correctional
officers, parole agents, park rangers, firefighters, and various other public safety personnel. The
cover letters from the Department of Human Resources accompanying these addenda were dated
May I, 2013. The JLBC is required to determine whether MOU addenda require legislative
approval.

Administration May Implement These Addenda. Under state law, the Legislature must
approve any provision of an MOU or similar agreement that requires the expenditure of funds.
These addenda would not result in the expenditure of funds not already approved by the
Legislature. Accordingly, the administration may implement these agreements with Bargaining
Units 6, 7, and 8 immediately without the need for additional legislative action.
